OneSaves.com Terms of Use - These terms are effective March 31st, 2009.
Welcome to www.OneSaves.com. Thanks for stopping by. By accessing OneSaves.com you are agreeing to the following terms, which are designed to make sure that OneSaves.com works for everyone.
Using OneSaves.com. You will post in the appropriate category or area and will not do any of the following bad things:
- violate any laws or our Prohibited Content Policy;
- be false or misleading;
- infringe any third-party right;
- distribute or contain spam, chain letters, or pyramid schemes;
- distribute viruses or any other technologies that may harm OneSaves.com or the interests or property of OneSaves.com users;
- impose an unreasonable load on our infrastructure or interfere with the proper working of the OneSaves.com;
- copy, modify, or distribute any other person's content;
- use any robot, spider, scraper or other automated means to access OneSaves.com and collect content for any purpose without our express written permission;
- harvest or otherwise collect information about others, including email addresses, without their consent;
- bypass measures used to prevent or restrict access to OneSaves.com.
Abusing OneSaves.com. Please use the flagging system to tell us about any problems or offensive content so that together we can keep the site working properly. We may limit or terminate our service, remove hosted content and take technical and legal steps to keep users off OneSaves.com if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off OneSaves.com or not, we do not accept any liability for monitoring OneSaves.com or for unauthorized or unlawful content on OneSaves.com or use of OneSaves.com by users.
When you choose to post your ad to another site, you may be responsible for ensuring that it does not violate our site policies. We may remove your ad if it is flagged on our site, or if we believe it causes problems or violates any law or policy.
Fees and Services. Using OneSaves.com is generally free. We may charge fees for certain services. If the service you use charges a fee, you'll be able to review and accept that charge. Our fees are quoted in Canadian Dollars, and we may change them from time to time. We'll notify you of changes to our fee policy by posting such changes on the site. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service. Our fees are non-refundable, and you are responsible for paying them when they're due. If you don't, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 180 days past due, we may deduct the amount owed from your PayPal account balance).
Content. OneSaves.com contains stuff from us, you, and other users. You agree not to copy, modify, or distribute OneSaves.com, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights to host and display your content.) If you believe that your rights have been violated, please notify our designated copyright agent at OneSaves.com Customer Support and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party's rights.
Liability. You agree not to hold us responsible for things other users post or do. As most of the stuff on OneSaves.com comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what's offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of OneSaves.com, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Canadian Dollars.
Personal Information. By using OneSaves.com, you agree to the collection, transfer, storage and use of your personal information by OneSaves.com (the "data controller") on servers located in Canada as further described in our privacy policy.
We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing. We may update this agreement at any time, with updates taking effect when you next use the site or after 30 days, whichever is sooner. OneSaves.com Policies
The following activities are prohibited from OneSaves.com:
Posting an item for sale that is
- not located in your area
- is illegal to own, buy or sell in your area of residence
- is in the prohibited items list
- Posting multiple Ads that are too similar to each other
- Posting an Ad that serves no other purpose than to send traffic to another web site
- Posting an Ad that defames anyone or contains "hate speech"
- Posting a multi-level marketing or other prohibited job
- Posting pornography, nudity or other prohibited personal
Any Ads or users that do not comply with the OneSaves.com policy will be removed and blocked from the site.
Our general rule is that you may not list, buy or sell items or services that are illegal to own, buy or sell in your Province or State of residence, or that are not bought or sold in compliance with applicable laws and regulations
YOU ARE RESPONSIBLE FOR ENSURING COMPLIANCE WITH ALL APPLICABLE LAWS RELATING TO THE ITEM YOU LIST, BUY OR SELL.
We specifically prohibit the following items:
- Alcoholic Beverages
- Baby Walkers
- Blood, Bodily Fluids and Body Parts
- Burglary Tools
- Counterfeit currency, stamps or coins
- Counterfeit Products
- Electronic Surveillance Equipment deigned or used primarily to illegally intercept/record the private actions or interactions of others without their knowledge or permission
- Embargoed Goods
- Escort or accompanying services
- Government and Transit Uniforms, IDs and Licenses
- Illegal Drugs & Drug Paraphernalia
- Illegal Services
- Hazardous Materials
- Fireworks, Destructive Devices and Explosives
- Identity Documents, Personal Financial Records & Personal Information (in any form, including mailing lists)
- Items which encourage or facilitate illegal activity
- Lottery Tickets, Sweepstakes Entries and Slot Machines
- Massage services
- Obscene Material and Child Pornography
- Offensive Material
- Pesticides
- Pictures or images that contain nudity
- Police Badges and Uniforms
- Prescription Drugs and Devices
- Prostitution or ads that offer sex, sexual favors or sexual actions in exchange for money
- Recalled items
- Satellite products that violate the Radiocommunication Act
- Sexual services, including camming
- Solicitation of other users except by placing an Ad
- Stocks and Other Securities
- Stolen Property
- Tobacco Products
- Used Cosmetics
- Weapons and related items (such as firearms, firearm parts and magazines, ammunition, BB and pellet guns, tear gas, stun guns, switchblade knives, and martial arts weapons)
The following types of Pet ads are prohibited on the site:
- The Animal Pedigree Act makes it a federal offence to sell an animal of a recognized breed as purebred, registered or eligible to be registered if it is not.
- Any Ad that violates the Animal Pedigree Act
The following types of Job ads are prohibited on the site:
- Multi-level marketing or pyramid schemes
- Business or job opportunities that require upfront or periodic payments
- Business or job opportunities that pay only commissions, unless the Ad makes it clear that the sole source of compensation would be commission and clearly describes the product or service that would be sold
- Business or job opportunities that require recruitment of other members, distributors or agents
- Ads that are not clear regarding what type of work would be required
The following types of Personal or Erotic Service ads are prohibited on the site:
- Ads that contain any sexual or pornographic content
- Ads that offer sex or sexual activities in exchange for money, products or services
- Ads that contain personally identifiable information such as a phone number or address
The following types of items are generally permitted to be listed if and to the extent that their sale and purchase is legally permitted in your Province of residence, and that such sales and purchases occur in compliance with applicable laws and regulations:
- Electronic Equipment
- Event Tickets
- Food Items
- Non-prescription Medical Devices
- Real Estate and Rental Properties
- Used Clothing and Bedding
- Vehicles, Vehicle Equipment and Devices
Other Posting Policies:
You can post unlimited different ads per day on OneSaves.com. Duplicate ads or ads that are too similar to an existing ad are not authorized and will be removed. The only exception to this is that you can post the same ad in two (2) different categories per (city) site within your province or state. Any more than two and your ads will be removed. We also ask that you not post outside the province or state you are located in. If you violate these policies your ads will be deleted (sometimes without notice). Attempting to post after having your ads removed may result in a "blocked" message notifying you that you have posted too many ads. To avoid this, please list whatever you are advertising only once per site within your province. If you want to re-list an item that you are already advertising on the site, delete your existing Ad first.
Posting a listing with a link to another web site for the sole purpose of directing visitors to that web site is not permitted. You may, however, include a link in your post if it is to give the user more information about the item being offered (for example product details, pictures, etc.).
You are not permitted to defame anyone or include "hate speech" directed at individuals or groups in your postings. OneSaves.com reserves the right to delete any Ads from the site that are deemed to negatively impact the community. If you encounter any such Ads, please flag it as such or contact us.
